Bombay Shops & Commercial Establishment Act, 1948- Amended in 2017- Basic & Mandatory Registration for the Commercial Establishments | Hemant Deshpande

Every employer who is running his business, profession, trade from the Municipal Corporation limits should obtain this license from Labour Office in Maharashtra. It is also called as “Gumasta Kayada” in Northern India.

Now a days, the registration is done online through the website of Government of Maharashtra i.e. www.aaplesarkar.com. For other states in India, one should visit other states websites and can find out the applicability.

Who can register : New and earlier establishments can register through this website and can obtain the Bank Receipt and License online.

Firms/establishments : Who has zero and above employees should register here. Objective of this Act is to protect the Interest of the Tiny Sector. As per the amendment, made by the Government of Maharashtra the State Government has taken a step further for the ease of doing business by amending the website of aaplesarkar.com. ( In the Year 2017).

Due to this amendment the firms who have less than 9 employees need not have to hold a license under this Act. The only payment of Bank Charges by way of online payment will help the employers to open an account in BANKS.( With the Form No. F- I.e. Intimation)

There are few conditions as per this Act that needs to be fulfilled by the unit e.g. Muster Cum Wage Register, Board in Devnagari etc. so that no penalties are levied upon on the unit by the Government authorities. It is always advisable to get it to done with the proper understanding of the implementation of the law.

  3. I have my firm/establishment in the Village adjacent to the City limits, am I supposed to obtain Shop Act license? : The law which is prevalent only will get applied as far as status of the organization is concerned.
  4. Who is the authority in case of Shop Act to be approached for? : Inspector Shops (under the Jurisdiction of Labor Commissioner’s office).
  5. I am having my Factory and Office as well, am I supposed to get the Shop Act license? : The law which is prevalent only will get applied as far as legal status of the organization is concerned.
  6. Are there any Government fees for the Shop Act license? The government fees are just Rs.23/- to get it registered under Shop Act.
